C On May 29, 2014, the Seoul Southern District Court sentenced a fine of KRW 10,000,000 to a violation of the Livestock Products Sanitary Control Act, etc., and the said judgment became final and conclusive on June 6, 2014.
[2014 Highest 1450] Defendant D is a selling company of livestock products located in Gangseo-gu Seoul Metropolitan Government, Defendant B is the real representative of Defendant D, Defendant C is in charge of payment of the price, employee salary, and work instruction as the wife of Defendant B, and Defendant A is a representative, product processing and delivery in the name of Defendant D.
1. Violation of the Act on Origin Labeling of Agricultural and Fishery Products;
(a) Defendants B, C, and A shall not sell agricultural and fishery products or the processed products thereof with the country of origin disguised, or store or display them for sale by mixing them with other agricultural and fishery products or the processed products thereof with the country of origin labeling;
Nevertheless, from April 2, 2012 to July 16, 2012, the Defendants conspired in collusion with the said “Stock Company D” and sold them by mixing the country of origin with other agricultural and fishery products in which the country of origin was indicated, by stating that all of the 50% of the bruic cridge 50% and the 50% of the domestic chillbridge was domestically produced, as if they were domestically produced, at the place of business, from April 2, 2012 to July 2, 2012, including selling the chillus, which is worth 70,171,300 won in total at the market price from April 2, 2012 to July 2, 2012, as shown in Appendix I.
B. Defendant D Co., Ltd. sold or sold agricultural and fishery products with the country of origin disguisedly or with the indication of origin mixed with other agricultural and fishery products, such as the foregoing paragraph, which is the actual representative and employee B, employee C, representative and employee of the Defendant.
2. Any person who intends to run livestock product processing business in violation of the Livestock Products Sanitary Control Act shall obtain permission from the Mayor/Do Governor for each workplace;
Nevertheless, Defendant B is the defendant.
