1. The Defendant’s KRW 70,000,000 as well as 5% per annum from March 1, 2009 to October 27, 2017 to the Plaintiff.

1. According to the purport of Gap evidence Nos. 1 and 2 as to the cause of the claim and the whole pleadings, the defendant borrowed KRW 70,000,000 to the plaintiff and paid due date on February 29, 2009.

“The Plaintiff prepared a loan certificate on July 21, 2008, and the Plaintiff wired KRW 70,000,000 to C’s account on July 21, 2008, and C wired KRW 70,000 to the Defendant’s account on the same day.

Therefore, the Defendant is obligated to pay to the Plaintiff 70,000,000 won with 5% per annum as stipulated by the Civil Act from March 1, 2009 to October 27, 2017, the delivery date of a copy of the complaint of this case from March 1, 2009, and 15% per annum as stipulated by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.

2. In conclusion, the plaintiff's claim is justified and it is so decided as per Disposition.
