피고인은 2020. 2. 1. 19:26경부터 같은 날 20:15경까지 술에 취한 상태에서 2회에 걸쳐 예천군 C에 있는 피해자의 집에 찾아가 피해자에게 술을 달라고 하였고, 이에 피해자가 112신고를 하여 출동한 경찰관이 피고인을 집으로 돌려보냈음에도 2020. 2. 1. 21:15경 재차 피해자의 집에 찾아가 피해자에게 ‘담배를 달라, 피해자의 집에서 닭똥 냄새가 난다, 보일러 소리가 크다’는 등의 이야기를 하던 중 피해자로부터 ‘이전에 파손한 보일러 배상금을 달라, 너 조현병 아니냐, 조현병은 집안 내력인데 너를 낳고도 부모님이 미역국을 먹었느냐’라는 이야기를 듣고 격분하여 평상시 소지하던 과도(총 길이 24cm, 날 길이 12.5cm, 증 제17호)로 피해자의 가슴을 2회 찌르고, 복부를 1회 찔러 피해자를 과다출혈 등으로 그 자리에서 사망하게 하였다.
