1. The revocation of a master's degree issued by the Defendant against the Plaintiff on July 27, 2018 shall be revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
Details of the disposition
On September 1, 2011, the Plaintiff entered B University Industry Graduate School Environmental Engineering and Master’s Degree Courses. From September 29, 201, to December 28, 2011, the professor C of the pertinent university participated in the research service called “D” (hereinafter “instant research service”) as a person in charge of research, and C submitted a service report to E, an incorporated association (Dissolution on January 2015) that ordered the said research service, after completing the said research service.
Around December 2013, the Plaintiff submitted a master’s degree thesis (hereinafter “F”) in the title of “F” (hereinafter “the instant dissertation”) with C’s instruction, and the Defendant granted a master’s degree to the Plaintiff around February 2014.
B University was informed on September 11, 2017 that the dissertation of this case constitutes research misconduct of plagiarism.
Accordingly, on March 6, 2018, the Research Ethics Committee of B University (hereinafter “Research Ethics Committee”) notified the Plaintiff on March 20, 2018 of the title “Notification of Results of Verification of the Research Ethics Committee,” which read “the instant dissertation is a research misconduct” or “self-determination”, according to whether the Plaintiff participated in the said research service.
(2) On April 11, 2018, the Plaintiff filed an objection to the instant determination with the Research Ethics Committee. However, on May 23, 2018, the Research Ethics Committee notified the Plaintiff of the title “the notice of confirmation of the outcome of plagiarism of a master’s degree thesis,” which read “the notice of confirmation of the outcome of plagiarism of a thesis with a master’s degree” as “the content of the instant determination is without any justifiable ground and thus dismissed.”
On June 18, 2018, the Plaintiff’s title “application for data on the results of verification of research misconduct” to the Research Ethics Committee.
