Reasons
1. Basic facts
A. 1) On June 12, 2012, the examiner of the Korean Intellectual Property Office (hereinafter referred to as “the patent application invention of this case”) submitted an amendment, such as a description of correction of the description and claims on September 12, 2012, to the Plaintiffs on the following grounds: “The nonobviousness of the patent application invention of this case is denied since the person with ordinary knowledge in the art to which the invention pertains (hereinafter “ordinary technician”) can easily make the invention from the preceding invention 1 and 2; and thus, the patent cannot be granted. 2) The Plaintiffs submitted an amendment, such as a description of correction of the description and claims on September 12, 2012. However, the examiner of the Korean Intellectual Property Office, on January 24, 2013, submitted the amendment, on the ground that the nonobviousness of the patent application of this case was denied from the preceding invention 1 and 2.
3) On April 12, 2013, the Plaintiffs filed a petition with the Intellectual Property Tribunal for a trial seeking revocation of the aforementioned decision of rejection (2013 Won2744). On September 23, 2014, the Intellectual Property Tribunal rendered the instant trial ruling dismissing the Plaintiffs’ petition for a trial on the ground that the nonobviousness is denied since ordinary technicians could easily make inventions from prior inventions 1.
