Punishment of the crime

1. The Defendant is a person who works at a D agency and has performed a work to deliver milk products, such as milk, to marina.

In the process of regularly delivering “G Mart” operated by the Victim F in Kimpo-si on July 1, 2014 to the G Mart on April 18, 2015, the Defendant deceptioned the victim by submitting to the victim a statement of transaction calculated including the number of omitted milk, even though he/she had supplied 2-3 of the milk inside the gambling place after deducting 2-3 of the said milk.

The defendant received the total amount of KRW 3,220,270, which is the price for the milk omitted from the damaged person for the above period and acquired it as the price for the milk sale.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and other crimes);

A. On October 27, 2014, the Defendant sought the victim’s smartphone (Evidence No. 1) from the Defendant’s smartphone (Evidence No. 1) located in the victim’s J (W, 44 years old) inside the mutual influence room located in Yangju-si, Yangju-si, and recorded the victim’s body against his/her will, by photographing the victim’s sexual intercourse head, which could cause sexual humiliation or shame.

B. On January 6, 2015, at around 16:15, the Defendant: (a) installed the Defendant’s smartphone on the table at the victim’s residence (hereinafter “victim’s residence”) located in K apartment in Kimpo-si, Kimpo-si; (b) sought a recording of the Defendant’s smartphone on the table; (c) taken the victim’s sexual intercourse head; and (d) taken the victim’s body against his/her will that may cause sexual humiliation or sense of shame.

On May 4, 2015, at around 16:35, the Defendant taken the body of the victim who could cause sexual humiliation or shame, by means of the same manner as the statement in the claim, and taken the body of the victim against his will.
