1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. Plaintiff A and B were the owners of the instant apartment Nos. 1/2, 1/2, 1/2, 1/2, 301 among the instant apartment Nos. 301, 1/2, 401, 501, 501, 601, and 601, and J was the owners of the instant apartment Nos. 701, 701, 201, 300, and 300,000.
The defendant is the council of occupants' representatives established to manage the apartment complex of this case.
B. K and L owned 1/2 shares of the instant apartment No. 901, but on November 20, 201, there was an accident where water supply and heating pipes installed inside the main wall of the instant apartment site No. 901 and water supply and heating pipes connected to the pipes of metal material and pipes of PV materials (hereinafter “instant piping parts”) were dried, and water supply and heating systems for water supply and heating were drained to the said apartment owned by the other plaintiffs except the network J and Plaintiff H (hereinafter “water supply”).
C. On July 4, 2014, M and Plaintiff H, the co-inheritors of the deceased J, entered into an agreement on division of inherited property, under which Plaintiff H independently inherited the damage claim arising from the water leakage in this case.
D. Meanwhile, the main contents of the instant management rules are as follows.
Article 5 (Scope of Part for Exclusive Use and Part for Common Use) (1) The exclusive part shall be the space used solely by occupants, etc. in the household, as specified in attached Table 2.
(2) The section for common use shall consist of the following housing sections, incidental facilities, and welfare facilities, and the site thereof, excluding the exclusive sections under paragraph (1), and the scope thereof shall be as specified in attached Table
1. Section for residential common use: Facilities jointly used by occupants of the relevant building, such as corridors, stairs and ductss of the building and elevators, on the ground floor of multi-family housing;
2. Other sections for common use: the area of dwelling, public use, excluding the area under subparagraph 1.
