피고인은 2015. 7. 2. 20:10경 광주 광산구 C아파트 209동 1313호에 있는 피해자 B의 집에 이르러 초인종을 눌러 사람이 없음을 확인한 다음, 미리 준비한 멍키 스패너와 드라이버를 출입문 열쇠꽂이에 넣어 젖히는 방법으로 문을 열고 들어가 침입하여, 그곳 안방 서랍에 피해자가 보관하고 있던 ① 시가 120만 원 상당의 순금 팔찌(5돈), ② 시가 400만 원 상당의 샤넬 반지, 팔찌, 목걸이 세트, ③ 시가 36만 원 상당의 18K 새끼 반지 2개, ④ 시가 150만 원 상당의 리골드 목걸이, 팔찌 세트, ⑤ 시가 300만 원 상당의 팔찌와 반지 세트, ⑥ 시가 50만 원 상당의 화이트 목걸이, ⑦ 시가 40만 원 상당의 하트 목걸이, ⑧ 시가 100만 원 상당의 이브생로랑 목걸이와 반지, ⑨ 시가 200만 원 상당의 14K 팔찌, 반지, 목걸이 세트, ⑩ 시가 30만 원 상당의 핑크 골드 팔찌, ⑪ 시가 150만 원 상당의 귀걸이 4개, ⑫ 시가 94만 원 상당의 순금 3돈 반지, ⑬ 시가 90만 원 상당의 진주 목걸이, 반지, 귀걸이 세트, ⑭ 시가 230만 원 상당의 목걸이 반지 세트, ⑮ 시가 7만 원 상당의 은목걸이 등 시가 합계 19,970,000원 상당(다만, 위 각 시가는 피해자 주장의 시가이다)의 귀금속을 가지고 가 절취하였다.
