Reasons
1. Facts of recognition;
A. A. Around August 4, 2003, as co-owners of the Seocho-gu Seoul Metropolitan Government E large 707.9 square meters and 8 other (hereinafter “owners”) entered into a contract to remove 9 households of multi-family housing on the said land and to construct a F apartment 12 households (the name was changed to G apartment; hereinafter “the instant apartment”).
B. The building owner, at the time of the said contract, entered into an agreement that the construction cost, excluding the prop contributions, shall be replaced by the sale price of the apartment units 101, 601, and 602 (hereinafter “101,” “601,” and “602”) but the building owner may sell the apartment units in advance after the commencement of construction work.
C. On September 1, 2004, Hoho Construction confirmed that the sales price was paid in full at KRW 101,720,000,000 for KRW 101,000,000, to H of Hoho Construction, and that on September 23, 2004, from among D and the owners of the construction, I and J made a sales contract confirmation to the effect that "No objection shall be raised after recognizing that Choho Construction was sold to Defendant B," among D and the owners of the construction.
On September 22, 2004, the Plaintiff lent KRW 200 million to Defendant B at the interest rate of 4% per annum, 66% per annum, 66% per annum, due date of payment on January 5, 2005, and hereinafter “construction of Choho General Construction Co., Ltd.”
(E) Defendant B jointly and severally guaranteed the above loan obligation against the Plaintiff. Meanwhile, on September 23, 2004, Defendant B transferred the sales right as to the above loan obligation to the Plaintiff on the security of the above loan obligation, and issued the sales contract and a written confirmation of the sales contract, and upon obtaining the approval of the construction of the title, entered the above transfer in the above sales contract (the details of the change of title).
F. The new apartment construction of this case was completed in May 2005 and it was decided to replace with construction cost on July 6, 2005, 101, 601, and 602, the building owner and the existing apartment house.
