1. The Defendants are jointly and severally liable to the Plaintiff for 209,000,000 won and the interest rate of 15% per annum from June 9, 2016 to the date of full payment.
Reasons
1. Indication of claim;
A. On December 2, 2015, Defendant B agreed to pay KRW 209,000,000 to the Plaintiff in installments on nine occasions from December 24, 2015 to August 25, 2016, and Defendant C jointly and severally guaranteed Defendant B’s obligation to pay the said agreed amount.
B. Since Defendant Gyeongnam Bank did not pay the money on the agreed date and lost the benefit of time, the Defendants are jointly and severally liable to pay the Plaintiff KRW 209,000,000 and delay damages.
2. Articles 208 (3) 1 and 257 (1) of the Civil Procedure Act of the applicable provisions of Acts;
