A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Reasons
Punishment of the crime
The defendant 2017 Highest 2498 is the representative of the E Co., Ltd. in Pyeongtaek-si D, who runs gold-type manufacturing business using 85 full-time workers.
1. When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, or other money or valuables within fourteen days after the cause for such payment occurred;
Nevertheless, the Defendant, from November 20, 2012 to July 23, 2017, did not pay KRW 4,816,847 of the F, who worked and retired from the said place of business, within 14 days from the date of retirement, without any agreement between the parties on the extension of the payment deadline.
2. An employer who violates the Guarantee of Retirement Benefits of a worker shall pay a retirement allowance within fourteen days after the ground for such payment occurred, in case where the worker retires; and
Nevertheless, the Defendant did not pay the total of KRW 59,951,611, including the total of KRW 13,948,398, and the retirement allowances of H from around July 1, 201 to October 12, 2017, including KRW 18,827,820, and KRW 14 days from around March 1, 2014 to around July 23, 2017, including KRW 13,948,398, and KRW 59,611, respectively, within 14 days from the date of retirement without an agreement between the parties on the extension of the payment period.
The defendant 2018 Highest 937 is the representative director of the E Co., Ltd. in Pyeongtaek-si I, who operates the manufacturing industry using 35 full-time workers.
Where an employee retires, an employer shall pay a retirement allowance within 14 days after the cause for such payment occurred.
The Defendant did not pay KRW 20,872,050 of retirement allowances of J from March 23, 2006 to August 16, 2017 to retired workers who worked in the said workplace within 14 days from the date of retirement without an agreement between the parties on the extension of the payment deadline.
