Reasons
Basic Facts
On June 22, 2018, the Plaintiff entered into a management contract with E (hereinafter “instant management contract”) which is the owner of the Gu building D (hereinafter “instant building”) during Ansan-si, and managed the instant building. The Defendant was the owner of the instant building, and the seller of the instant building to E on June 21, 2018, leased the Fho Lake and Gho (hereinafter “F & G”) of the instant building from E.
The defendant has not paid the management expenses under Fho Lake and G from December 2018 (the payment deadline of the following month) and has withdrawn only from Fho Lake around June 9, 2019. The management expenses unpaid by the defendant from December 2, 2018 to June 9, 2019 are KRW 10,904,370 in total, and the unpaid management expenses are KRW 37,225,80 in total, KRW 1,72,50 in total, KRW 38,998,30 in total, KRW 30 in total, KRW 300 in management expenses from December 9, 2018 to June 9, 2019, KRW 10,142,300 in arrears, KRW 38,98,300 in total, KRW 300 in the unpaid management expenses until March 20, 209, KRW 300 in the unpaid management expenses (the unpaid management expenses are KRW 30,97,309-1.630.9).
[Ground of recognition] The defendant is obligated to pay to the plaintiff the above 49,902,670 won, including the late payment charge, and delay damages for the above 49,902,670 won, unless there are special circumstances.
