1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. On April 18, 2012, the Plaintiff is a patient suffering from potential aftereffects of defoliants who was subject to disability rating under Article 14(3) [Attachment Table 3] of the Enforcement Decree of the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Service to the State, as a result of the Hemical heart disease (hereinafter in this case) from the Defendant.

B. 1) On January 21, 2016, the Plaintiff filed an application for a re-examination for the instant wounds with the Defendant. 2) On May 16, 2016, the Defendant rendered a disposition to the Plaintiff that the disability rating of the instant wounds constitutes class 7 and class 5111 of the Enforcement Decree of the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State (hereinafter the instant disposition).

2. Whether the disposition is lawful;

A. On January 13, 2016, the Plaintiff asserted that he was born to the emergency room of the Busan Veterans Hospital due to a heavy chest certificate around 20:00 on January 13, 2016, and then, on the 15th day of the same month, he was unable to perform clibal extension surgery because he was in the vicinity of the heart.

Therefore, the Plaintiff’s injury rating for the instant injury is not class 7 but class 6, since it constitutes a case where the Plaintiff received internal arbitration due to symptoms such as acute flaging, etc., and thus, the instant disposition is unlawful.
