Defendant

A shall be punished by a fine of KRW 3,000,00 and by a fine of KRW 1,500,000, respectively.

The above fine is imposed against the Defendants.

Punishment of the crime

Taking into account evidence and applicable legal provisions, the order or wording of the facts charged was partly revised to the extent that it does not infringe the defendants' right of defense.

Defendant

A is the representative of C University D D D (hereinafter referred to as “instant club”) and Defendant B is the director of the instant club. On December 31, 2019, E is a member of the instant club, who was registered as a candidate and elected on March 27, 2020 after registering as a candidate for the election of National Assembly members on December 31, 2019.

1. No one who has violated the Public Official Election Act and the Political Funds Act by the Defendants shall use any existing institution, organization, organization, or facility for any person who intends to be a candidate except an election campaign office, an election liaison office, and an election countermeasure organization;

Except as otherwise expressly provided for in the Public Official Election Act, no election campaign shall be conducted by means of broadcasting, newspapers, news communications, magazines, other publications, campaign meetings, debate meetings, debate meetings, native folks meetings, alumni meetings, neighbors' meetings, information and communications, the establishment of an election campaign organization or private organization, door-to-door visits, or other methods prior to the election campaign period.

No one shall distribute, post, distribute, screen, or display advertisements, personnel management books, posters, photographs, documents, drawings, pictures, printed matters, recording, video tape, and others similar thereto, which contain the contents of supporting and recommending a person who wishes to become a candidate, or which indicate the name of a candidate, with the aim of influencing an election from 180 days before the election day to the election day.

An election campaign by sending text messages by automatic broadcast communication may be carried out only by a candidate and a preliminary candidate.

Private meetings of individuals, such as native folks society, relatives' society, alumni association, alpine society, etc., and fraternity group, etc. may be conducted in the name of the institution or organization concerned or in the name of its representative.
