The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal (unfair sentencing) that the court below rendered on the defendant is too unfilled and unfair.

In light of the records and arguments of this case, there is no change of circumstances to consider the sentencing after the judgment of the court below, and there is a considerable interval between the previous violation of the Road Traffic Act (drinking driving) and the instant crime, etc., the various sentencing conditions indicated in the records and arguments are considered, even if considering the circumstances alleged by the prosecutor on the grounds of appeal, the sentence of the court below is too uneasible and unreasonable.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
