[Defendant A] The defendant shall be punished by imprisonment for eight months.
However, the above sentence shall be executed for two years from the date of the final judgment.
Reasons
Punishment of the crime
"2016 Highest 4592"- Defendant A is a person who operates a C Licensed Real Estate Agent Office.
1. The Defendant: (a) prepared a real estate sales contract stating that the purchase amount of 5,438 square meters of forests and fields E, Chungcheongnam-gun, Chungcheongnam-do, Chungcheongnam-do, which is owned by D, is high; and (b) submitted it to the F Association to obtain a large amount of loans.
On March 2013, 2013, the Defendant forged a private document (Investigation Records No. 235) on the part of the Defendant: (a) had H, who is aware of the circumstances, sell the forest land at KRW 120,000,000 to the “Land Sales Contract” paper using a computer to use it at the office of a licensed real estate agent in Bupyeong-gu Incheon, Incheon; and (b) had the seller enter and output the name of “D”, “I”’s personal information in the buyer column, “H’s brokerage office,” and “H’s personal information in the broker column; and (c) forged a land sales contract in the name of the victim of a private document, which is a private document on rights and obligations, with a seal affixed to the broker column.
B. On March 2013, 2013, the Defendant forged a copy of the land sales contract in the name of the victim D, which is a private document related to rights and obligations, with the content of the real estate sales contract for the said D to sell and purchase the said forest land to the said D in KRW 120 million in the form of the “Land sales contract” for the purpose of exercising it in the said office, and the seller’s personal information on the column, entered and printed out the buyer’s column with the personal information on the “I”, and then arbitrarily affixed a new seal on the back of the buyer’s name, affixed a copy of the land sales contract in the name of the victim D, which is a private document related to rights and obligations.
C. On April 2013, 2013, the Defendant forged a private document (concept 234 pages of the Investigation Record) that was kept in his/her office for the purpose of uttering at the said office on April 2013, 2013, in the form of “Sayang-gun E” of “Sayang-do in the seat of the seat of the seat with a knive pen,” “forest land in the land category column,” “5.438 square meters in the area column,” and the purchase price column.
