Punishment of the crime

1. On November 21, 2014, the Defendant purchased “11100 items” items from online games via cyber money in an amount equivalent to KRW 1,99,800, which is filled in by means of inputting information and communication devices without authority, by inputting the victim’s NAD and password from “CPC bank” located in Gwangju Mine-gu, Gwangju, and connecting the victim’s NAE with the victim’s NAV account “E”.

As such, the Defendant, without authority, sold online game items acquired by inputting information into computers and other information processing devices, to an unspecified five persons, and obtained pecuniary benefits equivalent to one million won by receiving the sales proceeds from the national bank account F in the name of the Defendant, and by cashing them.

2. No one who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Violation of Information and Communications Network, etc.) shall intrude on any information network.

Nevertheless, on November 21, 2014, the Defendant entered the victim's NAE and password, which was discovered by an influenite method at a place in the p.m., without authority, and accessed the victim's NAE into an information and communications network without access authority.

3. No person who violates the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. shall damage any other person's information processed, stored, or transmitted through an information and communications network, or infringe or divulge

Nevertheless, the Defendant, in the course of intrusion on the information and communications network like the above 'B', has damaged the victim's information processed and stored by the information and communications network by granting online approval on 41 times of the amount of 1,99,800 won charged to the victim's NAB account.
