1. Fraud;
A. On September 24, 2012, the Defendant made a false statement to the effect that “If a person lends a name to open a new mobile phone for the opening of a mobile phone, he/she will open a mobile phone but terminate it after three months.”
However, since the defendant opened a mobile phone in the name of the victim and thought to sell it in another place, he did not think that he would terminate the mobile phone opened in the name of the victim, and he did not have any intention or ability to pay normally the fee of the mobile phone opened in the name of the victim because he was liable for 30 million won.
The Defendant, as seen above, allowed the victim to use the name in the cell phone opening, opened one cell phone from “F” located in Bupyeong-gu Incheon Metropolitan City, by using SK Telecom to G, used the 1,067,440 won, and opened one cell phone using KT to H by December 5, 2012, and acquired the pecuniary benefits equivalent to KRW 1,217,560,000 in total by making use of KT to move one cell phone to H by December 4, 2012.
B. On January 21, 2013, the Defendant forged an application for enrollment in the name of K at the victim J's cell phone sales store located in the first floor of Dongdaemun-gu Seoul Metropolitan Government, and submitted the application for enrollment in the name of K to L employees and opened a mobile phone through a mobile phone, the Defendant left L as if he would normally pay L, and received one unit of galthopt 2 smartphone (M) equivalent to L’s market price of 989,000, and one unit of galthon 2 smartphone (N) equivalent to 859,000, market price of which is equivalent to 859,000, and did not pay 2,911,310 won from that time until June 2013.
The Defendant continues to do so in the name of K at the cell phone store of the victim PP located in Dongdaemun-gu Seoul Metropolitan GovernmentO.
