A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 2, 2013, at the D hotel coffee shop located in the Busan East-gu Busan Metropolitan City, the Defendant: (a) “I am in Indonesia, F am in Indones G, and F am in Indonesia, I would like to go to the Grand line. F ambling F’s gold bars in his possession; (b) had to be in charge of the transaction; and (c) would have been paid part of its profits if I sold gold bars with H, etc.; (d) if I lend money necessary to bring gold bars, such as the flight fare to Indonesia, etc., to Korea, I would pay back after the next, and if I lent the corporate card operated by the Party, I would like to pay the card price after using the corporate card.”

However, in fact, the defendant did not have received the F's request for the sale of gold bullion from the F, and only he thought that he would have borrowed money from the victim to pay his personal debt, etc., and even if he used the F's corporate card, he did not have the intention or ability to pay the money.

From March 5, 2013 to June 12, 2014, the Defendant: (a) by deceiving the victim; (b) received KRW 2.5 million from the victim as the borrowed money; and (c) received KRW 38,500,000 from the victim as the borrowed money on seven occasions from June 12, 2014; (d) paid KRW 30,000 for expenses by obtaining the corporate card under the name of (ju) I operated by the victim; and (e) paid KRW 30,000 for the use of expenses by the victim from July 8, 2013; and (e) paid a total of KRW 3,198,280 over 53 times as shown in the attached Table 2 of the List of Crimes.
