1. The plaintiff's claim is dismissed.

1. Basic facts

A. C Co., Ltd. whose representative director was the Plaintiff changed its trade name on April 27, 2005 to D Co., Ltd., and on the same day, the location of the headquarters was transferred from “Y” to “F”.

(hereinafter referred to as the “former C”). B. the trade name and location of the headquarters are the same as above.

G Co., Ltd. has changed its trade name on May 4, 2005 to C Co., Ltd. and the same month.

9. The location of the head office was transferred from "Y building 901, Jung-gu, Sungnam-gu, Sungnam-si, to "Yeman-si, Dong-si, Dong-si E"

(hereinafter referred to as the “New C”) with its trade name and location changed as above.

On January 22, 2002, the registration of ownership transfer was completed on January 22, 2002 with respect to the land E, 3,897 square meters of land for factory and its ground factory buildings (hereinafter the above land and buildings combined) owned by the Gu C. However, on April 14, 2005, the registration of ownership transfer was completed on April 14, 2005 on the ground of the trust property belonging to the same date in the former C. On the same day, the registration of ownership transfer was completed on April 13, 2005.

On April 2005, the assets, such as the instant plant, inventory goods, trademark rights, machinery, structure, forking vehicles, six vehicles (hereinafter “trademarks, etc.”) owned by the former C were transferred, and each of the promissory notes, as indicated below, issued by I (hereinafter “I”) were delivered to the Plaintiff with the proceeds of such transfer.
