A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On June 16, 2011, the Defendant was sentenced to 10 months of imprisonment for fraud and 2 years of suspended execution at the Changwon District Court. The above judgment became final and conclusive on June 24, 2011.
1. On April 2010, the Defendant: (a) recommended the victim D’s house located in the Seocho-gu Incheon Metropolitan City, 305 Dong-dong, 502, to purchase a lot of land on behalf of the victim to purchase a lot of land on behalf of the victim and to purchase a lot of land on the part of the victim; and (b) demanded the victim to purchase a lot of land on behalf of the victim to purchase a lot of land on behalf of the victim.
Accordingly, on April 22, 2010, the Defendant agreed to purchase the above land in KRW 300 million between the Plaintiff and H, who was the owner of the same f. 270 square meters per annum and 930 square meters per annum of the same Ri, in order to sell the above land in KRW 477 million to the victim, the Defendant issued a false real estate sales contract, stating that “The Defendant would have the victim purchase the above land in KRW 477 million, and would have the victim transfer the purchase price, so he would have the victim acquire the above land in KRW 70 million on April 22, 2010, KRW 70 million on April 27, 2010, KRW 700 million on April 27, 2010, KRW 700 million on June 11, 2010, KRW 700 million on June 27, 2010, KRW 701.7 billion on July 27, 2010.
B. On August 13, 2010, the Defendant agreed to purchase the said land in the amount of KRW 52 million between K and K, which had the owner of 321 square meters in Haan-gun, Haan-gun, Chungcheongnam-do, and JJ 335 square meters, and issued a false real estate sales contract, which was prepared to sell the said land in the amount of KRW 142 million to the victim, while issuing a false real estate sales contract, stating that “The Defendant would have the victim purchase the said land in the amount of KRW 142 million, so that he/she may transfer the purchase price to the said K,” and that it would have the victim transfer the purchase price to the said K on August 13, 2010, and on October 20, 2010.
