Reasons
1. Details of the disposition;
A. 1) The Defendant’s status as the party to the instant project around 2016 as the metal work incidental to the Urban Railroad 1, 2, and PED (SD) (hereinafter “instant project”).
(2) The Plaintiff participated in the said public offering, but was not finally selected as a contractor, as a person engaged in the advertising business under the trade name of “C”.
B. On December 17, 2016, the Plaintiff filed a claim for the disclosure of information and the trial of the preceding lawsuit with respect to the instant business with respect to the Defendant. On December 17, 2016, the Plaintiff filed a claim for the disclosure of information on the following information.
(a) A bill of quantity for calculation of basic amount for end-user institutions, including quantity and price for each type of work;
(b) A calculation sheet containing the quantities and prices submitted by the counter-party to the contract;
(c) A calculation sheet containing the quantity and price of the contract changed;
(d) Date of notification to the Public Procurement Service after the modification contract and the contract;
2. With respect to metal works (tender announcement: F, G) for facilities incidental to 1 and 2 lines PSSD for urban railroad secondary projects;
(a) A bill of quantity for calculation of basic amount for end-user institutions, including quantity and price for each type of work;
(b) A calculation sheet containing the quantities and prices submitted by the counter-party to the contract;
3. Affairs related to metal works for facilities incidental to urban railroad PED;
(a) Design drawings and work design specifications based on the bill of quantity of materials;
B. Construction specifications 2) On December 29, 2016, the Defendant disclosed some information as set forth in the following disclosure lists to the Plaintiff, but the remaining information is governed by the Official Information Disclosure Act (hereinafter “Information Disclosure Act”).
The disclosure of matters concerning a tendering contract or matters in the process of decision-making or internal review, etc. under Article 9 (1) 5 shall be made confidential on the grounds that there are reasonable grounds to believe that such disclosure may substantially interfere with the fair performance of duties.
