1. Defendant A shall be punished by imprisonment with prison labor for ten months;
However, the above sentence shall be executed for two years from the date of the final judgment.

Punishment of the crime
Defendant
A is a prosecutory investigator (Grade VII) who belongs to the H branch office of the Suwon District Prosecutors' Office, and Defendant B is the representative director of the J corporation located in Pyeongtaek-si I, and Defendant C is the representative director of the Pyeongtaek K corporation located in Pyeongtaek-si.

D (Representative M) A Co., Ltd. was established as “N” on August 24, 2009 for the purpose of real estate development, etc., and each trade name was changed to “O of a stock company” on January 8, 2010, and “D” on August 18, 2010.
1. On September 2007, Defendant B bid for a public auction procedure of the aggregate of 10,477 square meters of forests and fields on five parcels, such as Pyeongtaek-si P, Q, R, S, and T (hereinafter “the instant forest”). The instant forest was designated as a land transaction permission zone on November 14, 2002. The instant forest is a natural green area that is a land transaction permission zone. Since the Defendant is unable to register the ownership transfer by winning a successful bid under the name of the Defendant because it was not residing within the permitted area, the Defendant requested the Defendant’s wife located within the permitted area to lend his name to U.S. located within the permitted area.
Accordingly, on September 28, 2007, the Defendant participated in the bid for the instant forest under U’s name, and was awarded a successful bid of KRW 720 million on October 24, 2007, and entered into a contract with U on October 24, 2007 with Korea Land Trust Co., Ltd., a seller, and completed the registration of ownership transfer with U on October 30, 2007 for the instant forest under U’s name.
Accordingly, the Defendant registered the real right to real estate under the name of the title trustee according to the title trust agreement.
