1. The Defendant shall pay to the Plaintiff KRW 35,00,000 and interest rate of KRW 15% per annum from July 9, 2017 to the day of complete payment.
Reasons
1. Indication of claim:
A. The Plaintiff had the principal and legal interest of KRW 55,00,000 against C, and C had the claim against Defendant B and Nonparty D for the amount of KRW 50,000,000 of the Notarial Deed No. 122 of 2012, No. 1222 of 2012.
B. On January 23, 2014, C transferred the claim against the Defendant, etc. against the Defendant, etc., and notified the Defendant, etc. thereof on June 24, 2017.
C. Therefore, the Plaintiff seek payment of the amount of KRW 35 million, excluding the amount of KRW 15 million, which the Plaintiff agreed to receive from D as a legitimate transferee.
2. Grounds for determination: Article 208 (3) 3 of the Civil Procedure Act.
