A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 14, 2006, the Defendant was sentenced to a fine of one million won for a violation of the Road Traffic Act (driving) at the Incheon District Court on September 14, 2006. On November 29, 2007, the Defendant was sentenced to a suspended sentence of two years for eight months of imprisonment for a violation of the Road Traffic Act (driving) at the Incheon District Court on November 29, 2007. On June 27, 2008, the Defendant was sentenced to a fine of five million won for a violation of the Road Traffic Act (driving) at the Incheon District Court on June 27

The defendant is a person who is engaged in driving a B car.

On July 25, 2015, at around 23:00, the Defendant driven the above vehicle under the influence of alcohol by 0.127% of blood alcohol concentration, where the walk is 0.127% of the climatic face with red-light and smelling in the entrance, and 768 road on the west coast at the Gyeonggi City Estculing City, along the west of the game, turned directly from the west bank to the west bank of Jeju Island, and changed the lane into one lane.

이러한 경우 자동차의 운전업무에 종사하는 사람으로서는 전방 및 좌우를 잘 살피고 진로를 변경하려는 방향으로 방향지시등을 켠 후 다른 차량의 주행에 방해가 되지 않도록 조향 및 제동장치를 정확히 조작하여 안전하게 주행하여야 할 업무상의 주의의무가 있었음에도 이러한 주의의무를 게을리 한 채 만연히 진로를 변경한 과실로 마침 같은 방면으로 1차로에서 진행하고 있던 피해자 C(여, 29세)이 운전하는 D 아반떼 승용차의 조수석 앞 범퍼 부분을 피고인의 승용차의 운전석 뒤쪽 휀더 부분으로 들이받아 위 C에게 약 2주간의 치료를 요하는 다발성 좌상 등의 상해를, 그리고 위 C의 승용차 조수석에 탑승하고 있던 피해자 E(30세)에게 약 2주간의 치료를 요하는 경추부 염좌를 각각 입게 하였다.

Accordingly, the defendant was injured by the victims by driving a motor vehicle in a state where normal driving is difficult due to influence of drinking.
