Defendant B: the Plaintiff:

(a) Of the area of 1,548 square meters in 1,548 square meters in Jeonnam-gun, Jeonnam-gun, each point is indicated in the annexed drawings, , , , , , and , respectively.

1. Basic facts

A. Defendant C Fisheries Partnership (hereinafter “Defendant C”) was established on August 17, 2001 for the purpose of fostering and producing fish, shellfish, and other aquatic organisms, including abdomen, and Defendant C is the representative director of Defendant C.

B. On July 9, 2002, Defendant C completed the registration of ownership transfer for the reason of investment in kind on June 26, 2002 with respect to the Gambling-gun Gambling-gun, Jeonnam-do (hereinafter “instant G land”). On November 3, 2008, Defendant C completed the registration of ownership transfer for the reason of sale on October 15, 2008 with respect to Hambling-gun, Jeonnam-do, which was owned by F (hereinafter “instant H land”).

C. As to the size of 1,548 square meters (hereinafter “instant land”) prior to Donnam-gun, Jeonnam-do, which was owned by F, the Defendant B completed the registration of ownership transfer on January 27, 2015.

On July 31, 2018, I and J, the F’s creditor, obtained a decision to commence a compulsory auction on the instant D and E land (K; hereinafter “instant auction”), and the Plaintiff completed the registration of ownership transfer on May 21, 2019 by selling the instant D and E land, etc. in the instant auction procedure on May 16, 2019.

마. 한편, 이 사건 G, D, H, E 토지 등 지상에는 전복 치패 양식장 시설물(이하 ‘이 사건 양식장’이라 한다)이 설치되어 있는데, 이 사건 D 토지 중에는 별지 도면 표시 , , , , , , , 의 각 점을 차례로 연결한 선내 (가) 부분 971㎡(이하 ‘이 사건 가 토지’라 한다) 지상에, 이 사건 E 토지에는 별지 도면 , , , , , , , ¹, ¹, ¹, ¹, ¹, 의 각 점을 차례로 연결한 선내 (나) 부분 1,575㎡(이하 ‘이 사건 나 토지’라 한다) 지상에 이 사건 양식장 중 일부가 설치되어 있다.
