The judgment below

In light of the records, the court below dismissed the prosecution on the grounds that the facts charged were not specified as to the primary facts charged against the Defendants, and found the victim not guilty of habitual fraud on the ground that the part concerning the four specific facts charged are not recognized as habituality, and found the defendant guilty only for the ancillary facts of simple fraud, on the grounds as stated in its reasoning.

In light of the above, there is no ground of appeal that the court below erred by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal principles on the specification of facts charged and the permission for changes in indictment

On the other hand, the prosecutor appealed against the guilty portion of the judgment of the court below, but there is no indication of the grounds for appeal in the petition of appeal and no statement of the grounds for appeal can be found in the appellate brief.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
