1. The Defendants are identical to the Plaintiff A with respect to the 3/5 share of each real estate listed in the separate sheet No. 1, and to the Plaintiff B.
Reasons
1. Basic facts
A. On July 9, 1911, the land survey division drafted during the Japanese occupation point period is indicated as being in fact-finding 252 U on July 9, 191 (Seoul High Court 44 years).
B. On August 21, 1995, the Suwon-gun T. 252 had each real estate listed in the separate sheet No. 1 (hereinafter “each of the instant real estate”). On February 16, 1996, on the real estate listed in the separate sheet No. 1(a), the Republic of Korea received from the Suwon District Court registration office, No. 42525, and No. 8315, which received from the Suwon District Court registration Office as to the real estate listed in the same list No. 1(b) on February 16, 1996, and No. 74726, respectively, (hereinafter “each of the instant real estate registration in the name of the Republic of Korea”).
C. Meanwhile, U’s death on September 25, 1958, and V succeeded to the property of the Republic of Korea, and V died on December 7, 1983, and children, including Defendant P, succeeded to the property.
On June 27, 2013, Defendant P filed a lawsuit against the Republic of Korea to seek cancellation of each of the registration of initial ownership in the name of the Republic of Korea under the name of the Republic of Korea on the ground that each of the real estate of this case is invalid as the reason for the registration of initial ownership in the name of the Seoul Central District Court 2013Da174469, which is not U.S., the circumstances of each of the real estate of this case, and that the above U.S.’s heir is the real owner. Since then, the Defendants, including Defendant P, U’s heir, were to each of the instant real estates on February 20, 2014, and each of the instant real estates was registered by the Suwon District Court No. 27048 in accordance with the Defendants’ shares in the attached Table No. 2, and each of the instant Defendants’ respective registrations of preservation of ownership.
