Punishment of the crime

1. No person shall distribute, openly exhibit or exhibit child or juvenile pornography in violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials);

2. A person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Distribution of obscenity) shall not distribute obscene codes, words, sound, images, or videos through information and communications networks

Nevertheless, the defendant, at the same time and place as in Paragraph 1, shares obscene video images of 60 minutes, such as sexual conduct and similar sexual conduct, as Japanese adults appear in the same day and place as in Paragraph 1.

Accordingly, the Defendant distributed obscene images using information and communications networks.
