Reasons

Punishment of the crime

1. Defendant A of the instant case is the president of the “D Housing Redevelopment and Improvement Project Association” and Defendant B is the full-time director of the said association.

A housing redevelopment project partnership shall undergo a resolution of the general meeting comprised of its members in order to conclude a contract to become a partner other than the matters prescribed in the budget.

Nevertheless, the Defendants entered into a service agreement with the 142,340,000 won of the price to be borne by the members of the association, without the resolution of the general meeting of the union members, at the above partnership office located in the Gu E, for the early March 2013, the Defendants conducted the draft service related to the first general meeting of the union members (service performance period: March 16, 2013; March 29, 2013; March 2013).
