Defendants shall be punished by a fine of KRW 1,200,000.

The Defendants did not pay each of the above fines.

Punishment of the crime

1. Defendant A of the instant case is the president of the “D Housing Redevelopment and Improvement Project Association” and Defendant B is the full-time director of the said association.

A housing redevelopment project partnership shall undergo a resolution of the general meeting comprised of its members in order to conclude a contract to become a partner other than the matters prescribed in the budget.

Nevertheless, the Defendants entered into a service agreement with the 142,340,000 won of the price to be borne by the members of the association, without the resolution of the general meeting of the union members, at the above partnership office located in the Gu E, for the early March 2013, the Defendants conducted the draft service related to the first general meeting of the union members (service performance period: March 16, 2013; March 29, 2013; March 2013).

Accordingly, the Defendants conspired and concluded a contract to become a partner's burden in addition to the matters set out in the budget without going through the resolution of the general meeting of partners.

2. Defendant A is the president of the “D Housing Redevelopment and Improvement Project Association” and Defendant B is the full-time director of the said Union.

Where members of a cooperative or owners of a plot of land, etc. request the inspection or copying of documents and related data concerning the implementation of an improvement project, the executives of an association shall comply therewith within 15 days.

Nevertheless, the Defendants, at the above partnership office located in Ansan-si around February 5, 2014, filed an application and a certificate of the contents of the application with 18 members, including the list of union members (including telephone numbers and the actual place of residence) of the owners of the land, etc., the association inaugural general meeting held in November 201, the association inaugural general meeting held in February 25, 2012, the general meeting for the selection of the corporation on February 25, 2013, the general meeting of the general meeting and the establishment of the association on March 30, 2013, the written consent to the comprehensive establishment of the general meeting, such as the president of the association and the recommendation of executive officers, the receipt containing a copy of the union passbook and a simple receipt, and the written agreement with the maintenance service company.
