1. The Plaintiff:
A. Defendant B and C jointly share KRW 32,388,00 and KRW 11,648,00 among them, from October 22, 2016.
Reasons
1. The Plaintiff engaged in fishery products cultivating business under the trade name of “E” as to the claim for the payment of goods against Defendant B and C is “F” from November 20, 2015 to October 21, 2016. Since the remainder of the amount of goods unpaid to the Plaintiff supplied to Defendant B and C is not a dispute between the parties, Defendants B and C jointly have the obligation to pay the Plaintiff 11,648,000 won and damages for delay calculated annually from October 22, 2016 to March 19, 2020 to March 30, 2020, the date of delivery of a copy of the claim for the change of claim as of March 19, 2016, the remainder of the amount of goods unpaid to the Plaintiff supplied to the Defendant B and C is 11,648,000 won.
2. Determination as to the claim against Defendant D’s tort and the claim against Defendant B and C’s employer liability
A. Defendant D, while working as an employee of Defendant B and C, had the intent or ability to pay a new amount of money, deceiving the Plaintiff without any intention or ability, and was provided with a new amount of money equivalent to KRW 20,740,000 in total five times from September 16, 2016 to October 16, 2016. Defendant D, as an illegal act, is jointly and severally liable to pay the Plaintiff damages pursuant to Article 750 of the Civil Act; Defendant B and C, as the user of Defendant D, jointly with the Plaintiff pursuant to Article 756 of the Civil Act, with the aforementioned amount of KRW 20,740,00 as compensation for damages; from October 222, 2016 to March 29, 2020 to the date of service of a copy of the application for amendment of the claim as of March 29, 202, with each of the following amounts of damages for delay calculated at the rate of 15% per annum from the date of service of each claim.
(b) Applicable provisions of Acts: Judgment by deemed confessions under Articles 208 (3) 2 and 150 (3) of the Civil Procedure Act, Defendant B and C shall be the price of goods;
