A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
The Defendant intentionally faced with his shoulder, arms, and necks on the front side of the vehicle coming from the front side, caused a traffic accident (hereinafter “one-time hand”) and had the driver of the vehicle receive insurance from the insurance company, and had the driver receive insurance money.
1. Around 12:00 on June 13, 201, the Defendant: (a) discovered Category D Cargo Vehicles coming from the middle side of the 112-dong 4, Yeongdeungpo-gu, Seoul Metropolitan Government New-ro 491-4, Samsung 112, a secondary apartment at Samsung 112-dong; (b) intentionally face the right shoulder part on the right side of the said cargo vehicle.
Accordingly, the Defendant had C receive insurance from the victim Mtsts Fire Marine Insurance Co., Ltd., which is a policyholder of automobile insurance, and received 2,360,450 won of insurance money including medical expenses from the above insurance company, and acquired 4,704,250 won of insurance money, etc. by intentionally inducing traffic accidents on seven occasions in total, such as the attached crime list.
2. The Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (U.S.) finds out the GM5 vehicle from the FM5 vehicle driven in front of Geumcheon-gu Seoul, Geumcheon-gu, Seoul at around 11:10 on September 27, 2012, and intentionally fell against the latter part of the said SM5 vehicle.
The Defendant reported the so-called “vehicle” to the effect that F requested KRW 100,000 to F for consent, but F refused it, and that F was found to be the Seoul Geumcheon Police Station around 11:30 on the same day, and that “F escaped from his hand” to C of the Transport Survey Team in the Transport Survey Team.
As a result, the defendant made F a false accusation against the crimes under the Act on the Aggravated Punishment, etc. of Specific Crimes.
