1. The Defendant’s KRW 49,513,826 and KRW 48,349,00 among the Plaintiff’s KRW 49,513,826 shall be from November 13, 2018 to KRW 1,164,826.
Reasons
1. Facts recognized;
가. 원고가 2017. 12. 18.경 준공되어 사용승인을 얻은 <인천 남구 C빌딩(☞ 지상 4층짜리 제2종 근린생활시설; 이하 편의상 ‘이 사건 건물’이라고 한다)>의 건축주 겸 원시취득자인 사실, D 주식회사는 원고로부터 이 사건 건물의 신축공사를 도급받아 2017. 7. 하순경 착공하였고, 피고는 주식회사 E으로부터 이 사건 건물 부지에 인접한 F 토지 위에 지상 37층 규모의 오피스텔 신축공사를 도급받은 사실, 2017. 7. 하순경~2017. 12. 중순경 이 사건 건물의 신축공사와 위 오피스텔 신축공사 중 초기공사에 해당하는 토사 굴착과 버팀대 설치 공사가 함께 이루어진 사실은 당사자 사이에 다툼이 없고,
B. If the result of appraiser G’s appraisal (including the result of supplementary appraisal) added the purport of the entire pleadings, the Defendant did not adopt incomplete construction methods or take proper safety measures for nearby buildings, etc. in the course of conducting earth and sand excavation works, etc. necessary for the construction of the said officetel before December 2017, and thus, caused various damages, such as the ground of the instant building site part of the site, and the rupture of the parking lot floor, rooftop rail, etc. of the instant building while the ground of the instant building was duplicated, and the Plaintiff’s ground was invaded, and measured the fel of the instant building after undergoing a safety diagnosis on the instant building, or measuring the fel of the instant building in total to perform repair works for the remaining defects (=48,349,000,164,1664, part of the amount already needed).
2. Judgment on the issue
A. According to the above facts, the defendant neglected his duty of care in the process of the construction of the above officetels, thereby neglecting the plaintiff's property right.
