1. The Defendant’s KRW 35,750,000 as well as its annual 6% from January 11, 2020 to August 12, 2020, and the following.

In addition to the purport of the entire pleadings in Gap evidence Nos. 1 and 2, with respect to "D New Construction Project" on October 14, 2019 from the defendant, who is the contractor, the contractor, the construction contract was entered into between September 1, 2019 and September 30, 2019 with respect to "D New Construction Project", and the construction contract was completed between September 1, 2019 and September 30, 2019; the fact that the plaintiff completed the construction; the defendant prepared a letter of intent to pay the plaintiff the construction price of KRW 8575 million on December 19, 2019 to the plaintiff by January 10, 202; and each fact that the defendant paid five million won to the plaintiff is recognized.

According to the above facts, the defendant is obligated to pay the balance of the Corporation 3.575 million won (=8.75 million won - 5 million won) and the delayed damages calculated at each rate of 12% per annum under the Commercial Act from January 11, 2020 to August 12, 2020, the delivery date of the original copy of the payment order of this case from January 11, 2020, and from the next day to the day of full payment.

Thus, the plaintiff's claim of this case is accepted on the ground of the reasons.
