Reasons
Punishment of the crime
[Criminal Power] On November 2, 2018, the Defendant was sentenced to one year and two months of imprisonment for fraud, etc. in the Militarysan Branch of the Jeonju District Court on November 2, 2018, and completed the execution of the sentence in the Southern Prison on October 8, 2019.
【Criminal Facts】
1. After having been released from prison on October 8, 2019, the Defendant sought money from approximately 5-6 occasions after having been released from prison in the Namnam prison, the Defendant sought money from the friendly C’s house located in the Gunsan-si B. At that time, the Defendant conspiredd that the victim D (50 years of age) was dissatisfied with the fact that the police did not report money to the police and did not receive money, and attempted to murder the victim.
At around 10:40 on November 15, 2019, the Defendant: (a) entered the Defendant’s house into the said victim’s residence; (b) Party E, the victim of the instant victim’s house, called “Isle to find it again at the house,” and (c) Party E, the police officers who continued to receive a report, requested the Defendant to return home; (b) Party E, at around 11:40 on the same day, found the Defendant’s residence in the said victim’s house; (c) taken the kitchen knife (19cm in length, 30cm in total length) from the warehouse to enter the house in which the victim was located; (d) Party E, the victim was arrested by a police officer without entering the house.
Accordingly, the defendant prepared to kill the victim.
2. Intrusion upon residence;
A. On November 15, 2019, around 10:45, the Defendant infringed upon the residence of the victim, such as entering the house and warehouse, by opening a door in the residence of the said victim D.
B. As seen above, the Defendant was removed by a police officer who had invaded upon the victim’s residence and received a report, and sent out the surrounding areas, on November 15, 2019, the Defendant entered the house and warehouse through an open door at around 11:40 on November 15, 2019 and entered the house and warehouse (19cm in length and 30cm in total length).
