1. The defendant A shall be punished by imprisonment for one year;

However, with respect to Defendant A, the same shall apply for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, from November 8, 2015 to September of the same month, operated a game room with no trade name on the Daejeon Jung-gu E and the first underground floor, installed 46 game machine for the “sea-to-sea-to-air game”, which is a speculative electronic machine not classified by the Game Water Management Committee, and provided it to the unspecified number of customers who find the place. The Defendant, after having the said customers put cash into the game machine, let the said customers obtain the ground score according to the forest and the pattern on the game product screen, let the said customers obtain the ground score, and put the remainder points after deducting 10% from the acquired points to exchange it with the fee, thereby engaging in a speculative act using the game product, and at the same time, engaged in a speculative act using the speculative electronic machine.

2. Defendant B, while working as an employee of the game room at the date and time specified in the above paragraph 1, Defendant B, the owner of the business, installed 46 game for “sea-to-sea-to-sea” electronic gaming machines, which are not classified by the Game Water Management Committee, provided to unspecified multiple customers who find the place for use, and exchanged the remaining points after deducting 10% of the acquired points in terms of fees, into that place, with the knowledge of the fact that he/she conducts speculative business, he/she performed the said speculative business, by facilitating the said A’s speculative business.

3. On November 9, 2015, Defendant C and Defendant D worked as an employee of the game room at the places specified in the foregoing paragraph (1) around November 2015, and the owner of the business installs 46 game machine “sea-to-sea-to-sea-to-air game”, which is a speculative electronic machine not classified by the Game Water Management Committee, and provides the place to the unspecified number of customers who find it, and deducts 10% from the acquired points as commission.
