1. The Defendant: (a) from June 25, 2016 to Plaintiff A, KRW 29,960,00, KRW 36,560,00 to Plaintiff B, and each of the said money.
Reasons
1. Facts of recognition;
A. The Plaintiff, who entered into a sales contract between the Plaintiffs, entered into a sales contract with the Plaintiff B, with the content that the Plaintiff sold 330 square meters in Gyeyang-gu, Yangyang-gu and 190.33 square meters in Gyeyang-gu, Soyang-gu, 190.33 square meters in Mayang-gu, Goyang-gu, 198 square meters in the above F, and 132 square meters in the above G forest (hereinafter collectively referred to as “each of the above real estate”), but the Plaintiff B failed to complete the registration of transfer of ownership for all of the above real estate.
(B) The right to a double-story building on the ground of the construction of the road is the right that the plaintiff A could move and construct the building as the building owned by the land, such as Goyang-gu, Goyang-gu, Yangyang-gu, Yangyang-gu, Goyang-si, and the plaintiff A was to construct the building on the D's land, constructed the building in his own name, and transfer it to the plaintiff B.
(1) The Plaintiff B, without completing the registration of transfer of ownership under his name for the whole real estate of this case, sells to the Defendant and I a total of KRW 150 million on August 23, 2005, Oct. 25, 2005, and December 22, 2005 (i.e., the purchase contract of this case between the Plaintiff and the Defendant (i) KRW 1150 million (i.e., the purchase contract of this case) (hereinafter referred to as “the purchase contract of this case”).
A) The Defendant and I concluded a contract, and on January 9, 2006, completed the registration of ownership transfer on each of the above real estate. However, since the Plaintiff B failed to complete the registration of ownership transfer on each of the above real estate at the time of the conclusion of the contract, the copy of the register of each of the above real estate was recorded in the form of transfer from the Plaintiff A to the Defendant and I in accordance with the contract of sale and purchase. 2) Meanwhile, the Plaintiff.
