[Criminal facts]

1. The Defendant, around October 2008, in the office of the Dispute Resolution Co., Ltd., operated by the Defendant with the tenth floor of Seoul Gangnam-gu building C in Gangnam-gu, Seoul, the victim E, victim F, victim G, and victim H, who held a mine in the Chungcheongnambuk-gu voice, may generate profits by producing gold after six months.

If Korean company makes an investment with development funds, it will give more than twice the principal invested more than six months.

However, the defendant did not own a mine directly, and he owned the above mine around December 23, 2008.

On December 5, 2008, the Defendant received KRW 120,000,000,000 from the victims to a new bank account in the name of the Dispute Resolution Co., Ltd. (victim E, KRW 30,000,000,000,000 for victim G10,000,000 for victim H 10,000) and on December 19, 200, the sum of KRW 20,000 (victim F 20,000,000) to the above account was deposited.

Accordingly, the defendant was informed of the victims to receive property.

2. On November 2008, the Defendant, at the place described in Paragraph 1 above, may generate profits by generating gold from the victim J, holding a mine in the Chungcheongnambuk-gu voice that he/she operates.

If investment is made with development funds, it is expected to compensate for the profits of more than 80% of the principal invested and paid by distributing the principal and interest together.

However, the defendant did not own a mine and tried to engage in mining operations of gold mine.
