1. Revocation of a judgment of the first instance;

Reasons
1. Facts of recognition;
A. The member system of the company and the defendant's transactional relationship 1) The member system of the company (hereinafter referred to as the "alternative system").
(2) On December 31, 2008, the crew system received KRW 12,608,200,000, total amount of KRW 6,608,200 on December 2, 2008, from the Defendant for the supply of a rail dW-260C, etc. to the Defendant as a first transaction on December 1, 2008, and then traded with the Defendant by December 31, 201 after the resumption of the transaction with the Defendant on May 31, 2012.
On February 10, 2012, when trading, the member system paid to the defendant 16,206,320 won (19,176,320 won - 2,970,000 won (2,970,000 won) after deducting the sales amount of DW-260C supplied to the defendant on December 29, 201, from the sales amount of KRW 19,176,320 (19,176,320 - 2,970,000) incurred by the defendant by installing a rail to the member system on January 18, 2012.
B. Members system submitted a list of total tax invoices by customer at the competent tax office in 2008 upon filing a list of total tax invoices by customer. Of the above list of total tax invoices, the Defendant stated two copies of purchase of tax invoices, supply price of 17,169,50 won, tax amount of 1,716,950 won, and tax amount of 1,786,950 won (total amount of 18,886,450 won) at the competent tax office in 2008. The Defendant submitted a list of total tax invoices by purchaser at the tax office in 2008. The Defendant submitted a list of total tax invoices by customer at the tax office in 2008. The above list of total tax invoices system was written in 11,462,00,000 won, tax amount of 1,786,450 won, and 200 won.

On July 18, 2013, the Plaintiff filed a claim attachment and assignment order with the Daejeon District Court Branch (2013TTTT 5249) on the basis of the executory exemplification of the payment order for the check money case with the Seoul Northern District Court 2013j2160, the Seoul Northern District Court (2013TTT 201) against the Defendant who is the garnishee, 6,278,250 won out of the design pents, railings, bank protection fences, and other safety goods.
