The defendant's appeal is dismissed.

1. The sentence of the original court (four months of imprisonment) shall be too unreasonable, because of the gist of the grounds for appeal.

Determination factors are sentencing factors favorable to the Defendant, such as the fact that the Defendant recognized the instant crime, the fact that the Defendant paid most victims all the amount of damage, and the fact that the balance of punishment should be considered when the judgment was rendered simultaneously with the final judgment of the lower court.

However, the crime of this case is a crime against many unspecified persons who pretended to sell used goods through the Internet and acquired proceeds through the Internet, and its nature is inferior, such as undermining social trust in transactions through the Internet, and the defendant has already been punished several times, such as suspended execution, etc. due to a similar veterinary act fraud, and considering all the sentencing factors of the defendant, which are disadvantageous to the defendant, such as the sentencing factors, the age, character and conduct, the environment, the process and consequence of the crime of this case, and the circumstances after the crime, etc., the sentence of the court below against the defendant is appropriate.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
