A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
On April 26, 2002, the Defendant was sentenced to six months of imprisonment with prison labor for larceny, etc. at the Gangnam Branch of the Chuncheon District Court, and on July 25, 2002, the same court was sentenced to eight months of imprisonment with prison labor for attempted larceny, etc. on July 25, 2002; on December 16, 2004, the same court was sentenced to ten months of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; on September 25, 2014, the Defendant was sentenced to six months in imprisonment with prison labor for larceny, etc. at the same court on April 2, 2015; and on April 8, 2015, the Defendant was sentenced to six months of imprisonment with prison labor for an attempt to intrude a structure at night at the same court on July 17, 2016, and was under repeated crime for more than six years of imprisonment with prison labor, etc.
The Defendant committed the following crimes even with the mental retardation who lacks the ability to discern things or make decisions:
1. On August 3, 2016, the Defendant, in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes against the Victim C (thief) committed a theft with one gate of KRW 400,00,00,00 in cash owned by the Victim C (38 years of age) and one gift certificate of KRW 50,000,00,000 in cash owned by the Victim and one 20,000,000,000 won in cash owned by the Victim on the part of the Victim C, by opening and entering an unrecepted door by the Victim C (38 years of age).
Accordingly, the defendant abused the victim's property by intrusion into the room possessed by the victim at night.
2. On August 3, 2016, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) with respect to the Victim F by intrusion upon the Victim F and the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) committed by the Defendant into the house of the Victim F (68 years old, n, n, n) located in Gangseo-si G on August 3, 2016, by opening an entrance which is not corrected between the victim divingd and entering the residence
