The prosecutor's appeal is dismissed.

1. The sentence of the court below against the defendant (two years of suspended sentence for one year of imprisonment, two hours of probation, and forty hours of alcohol treatment) is too unfluent and unfair.

2. In full view of the following factors: (a) the Defendant recognized a crime and reflects the depth thereof; (b) the records of punishment for the same crime for the last twenty (20) years are only once fines; (c) the Defendant is a person with a 3rd disability; and (d) the Defendant’s age, character and conduct, environment, family relationship, and all other factors of sentencing specified in the instant pleadings, such as the Defendant’s age, character and behavior, family relationship, etc., it is deemed that the lower

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
