Reasons
Punishment of the crime
【2016 order 850】
1. The Defendant and the Victim C came to know through the “Creation of a Smartphone” Dolon around April 2015. The Defendant, at the E coffee shop located in Ulsan-gu, Ulsan-gu, around August 24, 2015, shall arrange to the victim’s business in order to join the SKNC’s construction company “after one month,” with the need to pay 7.5 million won as the liquidation cost is required, and thus, he/she will complete the payment with a loan of KRW 7.5 million.

However, the defendant did not have a business entity operated, did not have a plan to join the construction company, and even if he borrowed money from the damaged party due to no income, he did not have any intent to repay the money.
The Defendant received 7.5 million won from the victim’s new bank deposit account (F) in the name of the Defendant on the same day, and received 69,352,000 won in total from around that time to October 21, 2015, from the victim by deceiving the victim as above, as shown in the annexed crime list, from around that time to October 21, 2015.
Accordingly, the defendant was given property by deceiving the victim.

2. On November 16, 2015, the Defendant was accommodated in H hotel by a person suffering from Busan Shipping Daegu G G G in Busan on or around November 16, 2015, and the Defendant did not have the intent and ability to pay 286,000 won, which is the accommodation cost, even if he/she is accommodated in the hotel, because he/she did not have any other income.
Nevertheless, the Defendant was able to pay hotel employees a normal accommodation fee, and was accommodated in the hotel room from around November 27, 2015 to November 27, 2015.
The Defendant, by deceiving the victim, acquired a large amount of money of KRW 1,488,00 for accommodation expenses not paid.
