A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The defendant is a person who actually operates a corporation B(B’B’) that carries on real estate sales agency business.

1. On October 26, 2017, the Defendant against the victim C made a false statement to the effect that “A victim C can resell the right to sell a D apartment at present until December 2017, if the right to sell the D apartment at present, and may impose a penalty of KRW 10 million with the proceeds from the resale, and if the apartment is not sold after the lapse of 30 days after the completion of the apartment, he/she will purchase the apartment again at the cost plus KRW 10 million with the proceeds from the resale.”

However, in fact, around June 2017, the Defendant: (a) stated that E can obtain the above apartment unit proceeds from resale in a short period; (b) however, the real estate market in the Jeju area at the time was invaded at the time, and (c) had the victim purchase the above apartment unit E to demand the return of the down payment; and (b) had the victim demand E to purchase the right to sell the apartment unit; and (c) even if the victim purchased the right to sell the apartment unit, it was not possible for the victim to obtain the proceeds from resale in an amount equivalent to KRW 10 million until December 2017, 2017, after two months after the purchase; and (d) as the management of the apartment unit operated by the Defendant became worse and continuously accumulated, the balance in the account does not reach KRW 2 million, and thus, even if the apartment unit is completed, the victim did not have the intent or ability to purchase the right to sell the apartment unit again by up to KRW 10 million.

Around October 26, 2017, the Defendant, by deceiving the victim as above, received 3,1390,000 won from the F Bank account (Account Number) in the name of the Defendant’s management as the down payment from the victim.
