All appeals are dismissed.
Reasons
1. Defendant A and H’s grounds of appeal are examined together.
The judgment below
Examining the evidence duly admitted by the first instance court, which maintained the reasoning of the judgment below, the court below was just in finding Defendant A guilty of injury among the facts charged in this case on the grounds stated in its reasoning, and contrary to what is alleged in the grounds of appeal, there were no errors by violating the principle of court-oriented trial and the principle of direct examination, thereby exceeding the bounds of the principle of free evaluation of evidence
On the other hand, the argument that the court below erred by exceeding the inherent limits of the principle of balanced criminal punishment and the principle of responsibility in determining punishment against the Defendants is ultimately an assertion of unfair sentencing.
According to Article 383 subparagraph 4 of the Criminal Procedure Act, only in cases where death penalty, life imprisonment, or imprisonment or imprisonment without prison labor for more than ten years is imposed, an appeal on the grounds of unfair sentencing is allowed. Thus, in this case where a more minor sentence is imposed against the Defendants, the argument that the punishment is too unreasonable is not a legitimate ground for appeal
2. Prosecutor's grounds of appeal are examined.
The judgment below
In light of the records, the court of first instance cited by the court below, it is just to maintain the judgment of the court of first instance which acquitted Defendant A and B on the ground that there was no proof of crime regarding the violation of the Punishment of Violences, etc. Act (joint conflict) among the facts charged in this case against Defendant A and B, and there is no violation of the law of free evaluation of evidence against logical and empirical rules, contrary to what is alleged in the grounds of appeal.
3. All appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
