Defendant shall be punished by imprisonment for a term of one year and six months.

Punishment of the crime

On March 29, 2017, the Defendant sentenced the Seoul Southern District Court to two years of imprisonment for fraud, etc., and completed the execution of the sentence on October 31, 2018.

The Defendant and B returned to Seoul and Seoul Metropolitan area even though they did not have an intention or ability to purchase high-priced visibility, and searched sales text concerning high-priced visibility that can be commercialized through the sales site of used goods, and then sent the above sales text to a door-to-door phone as if they were to contact those who bought the above sales text with those who bought it, and agreed to distribute the sales proceeds after receiving it and selling it to the pawnpos, and the Defendant was willing to take charge of telephone communications, receipt of goods and disposal related to the sale and purchase of goods, and the Defendant was willing to take charge of driving the vehicle.

그리하여 피고인과 B은 2019. 3. 18. 22:30경 수원 이하 장소 불상지에서, 인터넷 중고물품 사이트에 롤렉스 서브마리너 청콤 시계를 판매하겠다는 글을 올린 피해자 C에게 전화로 연락하여 “위 시계를 구매할 테니 편의점 택배로 시계를 보내 달라. 택배 접수를 확인하는 즉시 대금을 송금하겠다.”라고 거짓말하여 이에 속은 피해자로 하여금 같은 날 23:07경 남양주시 D 1층 E편의점에 위 시계를 택배 접수하도록 한 후, 피해자로부터 택배 접수 송장 사진을 전송받자, 퀵서비스 업체에 전화하여 위 시계를 찾아다 주도록 주문하고, 위 편의점에 택배를 맡긴 사람 행세를 하면서 퀵서비스 기사를 통해 찾겠다고 전화하여 성명불상의 퀵서비스 기사를 통해 수원 이하 장소 불상지에서 위 시계를 교부받았다.

이로써 피고인은 B과 공모하여 피해자 소유인 시가 14,900,000원 상당의 롤렉스 서브마리너 청콤 시계 1개를 편취하였다.
