1. Basic facts

A. Of the instant real estate, the Defendant completed the registration of the establishment of a mortgage under the title of the Seoul Western District Court No. 2321, Jan. 19, 2016, the Seoul Western District Court No. 2321, Dec. 19, 201, regarding the Plaintiff’s share No. 187.1795/500, as indicated in No. 7 of the registry No. 1218, the title of the first floor C of the instant real estate and the ownership site No. 246.84m2 of the instant real estate and the Plaintiff’s ownership title No. 121, Dec. 6, 1091, the Defendant completed the registration of the establishment of a mortgage under the title of the Defendant’s 2nd floor D (333.07mm2, and the title of the ownership site No. 7 of the Plaintiff No. 1879/5000, Dec. 18, 1091.

Of the instant real property, the Defendant completed the registration of creation of a neighboring mortgage in accordance with the Seoul Western District Court No. 2323, Jan. 19, 2016, with respect to the maximum debt amount of KRW 130 million with respect to the Plaintiff’s equity indicated in No. 7 of the registry No. 187.1795/500 of the Plaintiff’s equity indicated in No. 12918, May 6, 1091, among the instant real property, as the Seoul Western District Court No. 2323, which was received on January 19, 2016.

C. The Plaintiff’s Dong G is the instant case.

On November 3, 2011, the business that he operated was the owner of the ownership site and C, D, and E, and completed the registration of ownership transfer after selling the said real estate to the Plaintiff in a foreign country where he was not able to repay.
