1. 피고인은 2015. 1. 26. 19:35경 부산 동래구 B에 있는 피고인의 주거지에서, 스마트폰 ‘카카오톡’을 이용하여 피해자 C(여, 24세)에게 “오빠, 고추도 크고 정력도 좋은데, 맥주한잔 하고 딸치고 오까 , 딸이 뭔데 , 니가 치주나, 딸치는 거 봐주믄 된다, 고추 발정나가 사창가 갔다 오고 싶다”는 내용의 문자를 전송함으로써 자기 또는 다른 사람의 성적 욕망을 유발하거나 만족시킬 목적으로 통신매체를 통하여 성적 수치심이나 혐오감을 일으키는 글을 상대방에게 도달하게 하였다.

2.
