Defendant shall be punished by a fine of KRW 1,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. A around 14:00 on October 15, 2012, the Defendant entered the title “A30,000 shareholders’ list” in the Non-Korean Certified Judicial Scriveners Office located in Seocho-gu Seoul Seocho-gu Seoul Metropolitan Government, and entered “A30,000 shareholders’ list” in the title “C’s representative director A,” and continued to imprint C’s corporate director’s name and affix his/her seal on October 16, 2012, and the title “A written consent of the total shareholders” was attached to “A”.

Accordingly, for the purpose of exercising the right, the Defendant made a copy of the register of shareholders, which is a private document concerning a certificate of fact, and a written consent of the total shareholders, respectively.

2. On October 16, 2012, around 12:22, the Defendant filed an application for change of the representative director by delivering the register of shareholders and the written consent of the total shareholders, together with the application for change of the company, to the registered public officials on his name as if they were duly formed with the application for change of the company, and the registered public officials who know such fact dismissed D from the inside director and completed registration of registering A and E as the inside director.

As a result, the defendant exercised a private document prepared with qualification ambiguous, and made a false report to a public official to enter false facts in the corporate register in the same electronic records as the original of the notarial deed, and exercised it immediately by making it available at the same time.
