A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

The Defendant is the user who runs a construction business with 13 full-time workers as the representative of Section C (Co., Ltd. as of December 12, 2012) located in Seocheon-si, Seocheon-si, Nowon-gu.

The Defendant, “2013 Highest 2483” from May 27, 201 to December 30, 2012, the Defendant did not pay the total of KRW 12,500,001 and the total of KRW 6,521,739 of the wages, including KRW 4,166,67, and the total of KRW 12,50,667, in October 201, to which he/she worked as the Deputy Director of Public Service at the said workplace from May 27, 2011 to December 30, 2012, and did not pay KRW 2,927,854, respectively, within 14 days from the date of retirement without an agreement on the extension of the payment date between the parties concerned.

The Defendant, from August 1, 2012 to December 6, 2012 of the same year, did not pay KRW 2.6 million for the total wages of KRW 16,380,000,000 for four employees, as stated in the attached Form, as stated in the notice of arrears, without any agreement on extension of the due date, within 14 days from the date of retirement.

The Defendant, from June 18, 2013 to November 1, 2011 of the same year, did not pay KRW 1,30,000,000,000 to seven employees, as stated in the attached Table, for the total amount of wages of KRW 34,598,489, which is the seven employees, within 14 days from the date of retirement without agreement on extension of the due date.
